House Passes “Todd’s Law”

Today the House met to complete legislative action on Senate Bill 106 which will exempt professional engineer members from the sanitary board when a project engineer is under contract. The House completed legislative action on four other bills. 

The House rejected Senate Bill 170. The members then moved to reconsider the bill. It is laid over one day to consider further amendments. The bill would authorize the bureau of commerce to promulgate legislative rules. 

The House passed five other bills. One bill was Senate Bill 287 “Todd’s Law”, which would provide posthumous high school diplomas.

The House adopted 48 resolutions. One was House Resolution 18, memorializing the life of the Honorable Charles Raymond Shaffer.

Senate Completes Action on 13 Bills, Passes 11 Others

The Senate met and completed legislation on 14 bills during the floor session today. Six of the bills completed were Senate bills which completed following the concurrence in House amendments and passage, including Senate Bill 30, permitting shared animal ownership agreements to consume raw milk. House Bills 2213 and 2576 completed following the adoption of conference reports and passage. House Bill 2213 would reduce the distribution to the West Virginia Infrastructure Fund. House Bill 2576 would create new code sections which separates the executive departments. 

In addition to bills that completed, 11 bills passed on third reading, including House Bills 2478 and 2627. House Bill 2478 relates to the finance of public schools and was passed following the adoption of an amendment. House Bill 2627 seeks to provide protection against property crimes committed against coal mines, utilities and other industrial facilities.

Twenty-four bills on second reading were advanced to third reading, including House Bill 2793, which was advanced to with the right to amend. 

Eight bills were taken up for immediate consideration and read a first time.

The Senate also adopted Senate Resolutions 55 and 56. Senate Resolution 55 recognized March 11, 2015 as Preston County Day at the Legislature. Senate Resolution 56 memorializes the life of the Honorable Mack Jarrell, a former member of the West Virginia Senate.

UPDATE: 

The Senate reconvened this evening and repassed Senate Bill 30 following a reconsideration of the previous passage. The Senate amended the House amendments and passed the bill, now requesting the House to concur in their amendments. 

The Senate also reported bills from their respective committees, and three bills were taken up for immediate consideration and read a first time. 

The Senate is adjounred until 11 a.m tomorrow.

House Completes Legislative Action for Senate Bill 336

Today the House met to complete legislative action on Senate Bill 336. This bill would eliminate the Health Care Authority’s power to apply certain penalties to future rate applications.  

Senate Bill 502 was moved from the regular calendar to the special calendar and read for a third time. This bill would relate to eligibility for certain reclamation or remediation tax credit. The bill was passed and awaits the concurrence of the Senate. 

Eighteen bills were read for a second time. One bill was Senate Bill 581 which relates to the Tourism Promotion Fund and Courtesy Patrol Fund. The bill was amended by the Finance Committee. 

The House adopted four resolutions including, HCR 130, HCR131, HCR 132, and HCR 133.

The House reconvened this evening to complete legislative action on House Bill 2586, House Bill 2632, House Bill 2914 and House Bill 2648. HB 2586 would allow for an alternative form of service of process in actions against nonresident persons by petitioners seeking domestic violence or personal safety relief. HB 2632 would exempt the procurement of certain instructional materials for use in and in support of public schools from the division of purchasing requirements. HB 2914 would provide for voluntary dissolution of resort area districts. HB 2648 would allow authorized entities to maintain a stock of epinephrine auto-injectors to be used for emergency. 

THe House passed House Bill 2550. This bill would increase the number of unexcused absences of a student before action may be taken against the parent. 

The House also debated amendments on Senate Bill 347, the Firearm Act of 2015. They also debated amendments to House Bill 2016, the Budget Bill.

House Passes Raw Milk Bill, Completes Legislative Action on HB 2880

During today’s floor session, the House completed legislative action on 11 bills including House Bill 2880 which would create an addiction treatment pilot program.  Another bill to complete legislative action was Senate Bill 2053, which would relate to the form of trust deeds. Other bills that are now completed legislation include Senate Bill 2535 , relating generally to suicide prevention training, “Jamie’s Law, ” and Senate Bill 322, which will eliminate mandatory electronic recount of ballots in recounts.

The House also passed twelve bills including Senate Bill 30, which would permit shared animal ownership agreement to consume raw milk. Senate Bill 578, which relates to occupational disease claims, was amended and passed. Also amended and passed was Senate Bill 574, which would relate to liquor sales by distilleries and mini- distilleries. 

Senate Bill 336, eliminating Health Care Authority’s power to apply certain penalties to future rate applications, was the only bill advanced to third reading and thirty bills on first reading were advanced to second reading including House Bill 2016, the Budget Bill.

The House also adopted several resolutions including HCR 6, HCR7, SCR18, SCR19, HCR24, HCR31,SCR31,HCR42, HCR45, SCR47, HCR55, HCR58, HCR60, HCR65, HCR68, HCR98, and HCR113

Medical Professional Liability Reform Bill Completes Action

The Senate completed action on two Senate bills and one House bill during today’s floor session. Senate Bill 6, relating to medical professional liability, and Senate Bill 421, relating to punitive damages in civil actions, completed following the Senate’s concurrence in the House amendments and passage of the bills. House Bill 2562, relating to sales tax increment financing, completed legislation after being read for a third time. 

After receiving a House message for Senate Bill 532, the Senate amended House amendments and passed the bill. SB 532 relates to civil liability immunity for clinical practice plans and medical and dental school personnel. The bill now awaits the House concurrence of the Senate’s amendments. 

Three other bills on third reading were passed, including HB 2586. House Bill 2586 would allow for an alternative form of service of process in actions against nonresident persons by petitioners seeking domestic violence or personal safety relief. 

Seventeen bills on second reading were advanced to third, and eight bills were taken up for immediate consideration and advanced to second reading. 

Several resolutions were adopted during the Senate’s floor session today. SR 52 recognized May 4, 2015 as National FPIES Awareness Day. SR 53 recognized Major General James A. Hoyer, winner of the 2015 Spirit of the Mountains- Lewis N. McManus Youth Leadership Association Service Award. SR 54 designated March of 2015 American Red Cross Month.

House Amends Non-Partisan Election of Judges to Address Veto

The House reconvened this evening and completed legislative action after hearing Senate messages and messages from the Governor. House Bill 2010, relation to the non-partisan election of judges, was amended to address concerns in a veto by Governor Tomblin. The amended bill was passed by the House and sent to the Senate.

The House also concurred with amendments to Senate Bill 6 to meet the objections of the governor. The bill has completed legislative action again and has been sent to the governor. This bill relates to medical professional liability.

The House also concurred Senate amendments for House Bill 2272 and passed it. This bill relates to the authority of the Board of Pharmarcy. 

The House concurred with Senate amendments for and passed two other bills.

House Completes Action Regarding Issuance of Certificate of Certain Births

Today the House met to complete legislative action on Senate Bill 277, which will require issuance of certificate of birth resulting in stillbirth. 

The House also passed eight other bills. Senate Bill 421 was amended on third reading, this bill relates to punitive damages in civil actions. Another bill that passed the House was Senate Bill 532 which relates to civil liability immunity for clinical practice plans and medical and dental school personnel. These bills were amended and go to the Senate for concurrance.

The House also advanced 19 bills to third reading. 

 

The Finance Committee will hold a public hearing tomorrow at 8 a.m. in the House Chamber regarding Senate Bill 14, relating to creating the Public Charter Schools Act of 2015.

Senate Completes Action on Eleven Bills

Eleven bills completed legislative action during today’s Senate floor session, including Senate Bill 559 and House Bill 2626. SB 559, relating to social work licensing exemptions, completed following the Senate’s concurrence in the House amendments. HB 2626 relates to the use of the Abandoned Land Reclamation Fund and modifying limations on the use of federal grants allocated for water and land reclamation needs. The eleven bills now await the Governor’s signature. 

The Senate also passed twelve bills on third reading, and lied over House Bills 2368 and 2562 for one day. HB 2368 relates to child welfare, and HB 2567 relates to electing members of county school boards on a nonpartisan basis in general elections only. 

Two bills on second reading were advanced to third following the adoption of amendments. 

Eight bills were taken up for immediate consideration and advanced to second reading. 

The Senate also adopted Senate Resolution 51 today, recognizing Nancy Stuart Tonkin, a long-time staff member at the State Capitol.

Senate Advances Twenty Three Bills to Third; Judiciary to Meet Tonight

the Senate Read 23 bills for a second time during today’s floor session. seven were amended and two were advanced to third with the right to amend. House Bill 2368 would equire the Secretary of the Department of Health and Human Services to make annual reports to the Health and Human Resources Committees of the Senate and House of Delegates concerning child fatalities or near fatalities as documented by the Bureau for Children and Families Child Protective Services. House Bill 2632 would exempt the procurement of certain instructional materials for use in and in support of public schools from the division of purchasing requirements. 

House Bill 2586 and House Bill 2914 were read a first time.

Delegate Miller Serves as Majority Leader For Saturday Floor Session

Delegate Carol Miller (R-Cabell) served as Majority Leader on the floor today. This marked the first time a female delegate has served as Majority Leader on the floor of the House of Delegates. She already made history as the first female Assistant Majority Leader and the first female in a leadership position in a Republican led majority of the House of Delegates.

The House amended Senate Bill 532, relating to civil liability immunity for clinical practice plans and medical and dental school personnel was advanced to third.

Another bill that was read for a second time was House Bill 2769, which would move expiring funds to the unappropriated surplus balance in the State Fund and General Revenue from various agencies. Seven other bills were read for a second time.

Nineteen bills were read for a first time.

The House also adopted Senate Concurrent Resolution 50 which provides for the issuance of refunding bonds pursuant to Safe Roads Amendment of 1966.
