Bill Repealing Outdated Health Code Moves to Second Reading

The House met today introducing several bills and resolutions.

Today, two bills were on first reading.

House Bill 4059 clarifies that deputy commissioners at the DHHR are not eligible for classified exempt from civil service.

House Bill 4060 repeals outdates code sections including Article 5Z, Article 52, and Article 55.

Senate Advances Intermediate Court Bill

Then Senate met briefly Monday morning, advancing Senate Bill 244 to second reading. The bill relates to procedures for initial appointment of judges to the Intermediate Court of Appeals. The bill will be on amendment stage tomorrow with a final vote in the Senate likely on Wednesday.

The body introduced bills 275-412.

House Announces Meetings for Monday

The House met briefly today to introduce bills and resolutions.

The following Committee Meetings will take place Monday, January 17, 2022:

The Judiciary Committee will meet after the floor session in Room 410.

The Committee on Government Organization will meet after floor session in the House Chamber.

The Committee on Technology and Infrastructure will meet after floor session in Room 434.

The Committee on Veterans Affairs and Homeland Security will meet at 2 p.m. in Room 410.

The Committee on Education will meet at 3 p.m. in Room 434.

A public hearing on House Bills 4004 and 4005 will be held at 3 p.m. on January 17 in the House Chamber.

Abortion Bill Discussed in First HHR Committee Meeting

The Committee on Health and Human Resources met today passing four bills.

House Bills 4059 and 4060 have moved to the floor.

House Bill 4059 clarifies that deputy commissioners within the DHHR are not eligible for classified exempt service.

House Bill 4060 repeals outdated sections of code relating to State Coalition for Diabetes Management, Coalition for Responsible Pain Management, and State Advisory Coalition on Palliative Care. These coalitions have fulfilled their duties and are no longer in existence.

House Bills 4004 and 4005 will be referred to the Judiciary Committee.

House Bills 4004 prohibits abortions after 15 weeks. The bill does include a medical emergency exception, which is definite as “any condition which, in the reasonable medical judgment of the patient’s physician, so complicates the medical condition of a pregnant female to the necessitate the immediate termination of her pregnancy to avert her death or for which a delay will create service risk of substantial or irreversible physical impartment to bodily function.” The exception does not include the psychological or emotional condition of the patient.

House Bill 4005 prohibits the sale, transfer, and transportation of fetal body parts within the state of West Virginia. There is a federal law that prohibits the sale, transfer, or transportation of deal parts across state lines.

The Committee will host a public hearing on Monday, January 17, 2022 at 3 p.m. on House Bills 4004 and 4005.

Senate Introduces 17 Bills During Brief Floor Session

The Senate introduced 17 bills during a very brief Thursday morning floor session.

Senate bill 257 would increase West Virginia State Police salaries.

The Senate is adjourned until tomorrow, Jan. 14 at 9:00 a.m.

House Introduces 24 Bills during Quick Floor Session

The House convened for day two of the 2022 session. Twenty-four bills and seven resolutions were introduced.

House Bill 4001 was introduced. The bill would create the Legislative Oversight Commission on the Department of Economic Development Accountability.  The bill also creates the Conduit Installation Fund, the Dig Once Fund, the Broadband Middle Mile Fund, and the Pole Replacement and Relocation Fund. HB 4001 also creates customer protections for the Office of the Attorney General in coordination with the Office of Broadband and Department of Economic Development.

Senate Passes 18 Bills on Opening Day of 2022 Regular Session

The Senate convened the Second Regular Session of the 85th Legislature Wednesday at Noon, moving quickly to pass 18 bills.

The body suspended the constitutional rules that require a bill to be read on three separate days to pass these measures immediately. All of these bills were passed overwhelmingly by the Senate during the 2021 Regular Session, but were never acted on by the House of Delegates.

Highlighting a couple bills passed today, Senate Bill 9 would provide continued eligibility for developmental disability services to dependents of military members, and Senate Bill 170 would provide West Virginia veterans discounts on fees and charges at state parks.

The Senate introduced 231 additional bills and sent them to committee during today’s floor session.

UPDATE

The Senate reconvened Wednesday evening at 5 p.m. to receive the Budget Bill from the Governor. The bill has been referred to the Finance Committee.

The Senate is adjourned until tomorrow at 11 a.m.

Senate finance will meet tomorrow at 9:30 a.m. in 451M for the Governor’s budget presentation.

 

 

House Convenes for Second Session of 85th Legislature

The House of Delegates convened for the first day of the second session of the 85th Legislature.

The House introduced 172 bills and referred them to committees. Four House Resolutions were introduced, references were dispensed with and the resolutions were adopted. Eighteen (18) Joint Resolutions and 11 concurrent were introduced and referred to committees.

The House is in recess until 5 p.m.

House Passes WV Industrial Advancement Act

Today, the Legislature convened for Day 2 of the First Special Session of 2022. The Senate convened at 9 a.m. and recessed immediately, waiting for the bills to be passed by the House. The House convened at 9 a.m.

After a lengthy discussion, Senate Bill 1001, The West Virginia Industrial Advancement Act passed 91 to 2. The bill provides tax credits to qualifying labor-intensive heavy industrial manufactures. The bill specifies the transfer of the credit to successors in business and retention of credit to change in form of doing business.

Senate Bills 1002 through 1006 were also passed, all supplemental appropriations.

Senate Bill 1002 moves federal funds from Treasury to the Coronavirus State Fiscal Recovery Fund.

Senate Bill 1006 moves money from the General Revenue State Fund to the Department of Economic Development.

The House is in recess until 4 p.m.

The Senate reconvene at 11:45 a.m. and concurred to complete Senate Bills 1004 and 1005.

The Senate also confirmed the Governor’s Executive Nominations.

The Senate is in recess until 4 p.m.

The House and Senate reconvened at 4 p.m.

The House received messages.

Both, the House and the Senate, are adjourned sine die.

Legislature Convenes Special Session, Senate Quickly Passes Bills

The Senate convened the First Special Session of 2022, quickly suspending the constitutional rules and passing all six bills on the Governor’s Special Session Call.

The call describes a “policy to provide certain tax incentives, based upon certain investment and employment thresholds, to promote development and expansion of new labor and capital intensive heavy industry in this State.”

The main tax incentive bill, Senate Bill 1001, dubbed the West Virginia Industrial Advancement Act, was passed 30-1 in the Senate.

The five other items on the passed this morning are supplemental appropriations bills, mainly account transfers of stimulus or federal Covid-19 relief money to state agencies, with one sending money to the state Department of Economic Development. These bills now head to the House of Delegates for consideration.

The House met briefly to introduce bills, and have a Finance meeting scheduled for 2 p.m. in the House Chamber to consider the legislation.

The House will reconvene at 6 p.m.

The Senate is adjourned until tomorrow at 9 a.m.
