Senate Continues Passing Bills, Honors School Counselors and Marshall University

The Senate convened today at 11 a.m.

Senate Bills 352-369 were introduced today.

The Senate adopted Senate Resolution 15, SR 16, and SR 17. SR 15 designated January 24, 2018 as School Counselors Day while SR 16 designated January 24, 2018 as Marshall University Day as well. SR 17 recognized the Marshall University football team.

The Senate passed five bills today. Of those bills SB 37 equalized the penalty for entering without breaking regardless of time of day and SB 39 created the Sexual Assault Victim’s Bill of Rights.

There were six bills on the first reading today.

Senate Bill 284 Moves Through Senate Education Committee

The Senate Education Committee approved Senate Bill 284 with amendments to be sent to the Senate Judiciary Committee.

Some amendments to the bill include allowing students enrolled in home schooling or private instututions to be permitted into the grant program along with students in public West Virginia schools.

Senator Michael Romano (D – Harrison) spoke to the committee about lowering the required age to 18 years old or who hold a high school diploma or the equivalent of.

High school student Elizabeth Ours spoke to the committee about the importance of agriculture classes in high schools. Ours proposed to the committee that high schools should offer agriculture classes as an option for a science course instead of just an elective.

Senator Robert Beach (D – Monongalia) referenced House Bill 2855 – The Robert C. Beach Vocational Agriculture Credit – from 1999 that gave counties the option to allow for two semesters of agriculture classes to be made into one science credit. The committee adopted a study Resolution to look into the matter further to see if the code has been required and how to enable it any further.

Senate Bill 146 Passes Through to the House

The Senate convened today at 11 a.m.

Senate Bill 146 correcting a technical error within the Solid Waste Management Act was passed.

Five bills were on the floor for second reading. SB 292, relating to Commission on Special Investigations, was amended on the floor.

SB 339-350 were introduced for the first time today.

The Senate also adopted Senate Resolution 14 designating January 23, 2018, as Higher Education Day.

The Senate is adjourned until 11 a.m. tomorrow.

House Passes H.B. 2028

The House convened today at 11 a.m.

The House passed bill 2028 – relating to the venue for suits and other actions against the state – 96-0, with three absent or not voting. The purpose of this bill is to allow a plaintiff or petitioner to file a claim or petition against the state, a state officer, or state agency in the circuit court of a county in which the plaintiff or petitioner resides or in which a claim arose as well as in the Circuit Court of Kanawha County.

Several members of the House expressed their concern about the future of education and cuts to teacher pay and benefits in the state of West Virginia. Many delegates urged the members of the House to be mindful of how the state depends on education and its teachers for the progression of the state.

Three bills were read a second time – H.B. 2607, H.B. 2822, and H.B. 2838 – and advanced to third reading.

Delegate Arvon Resigns, is Appointed to Senate Replacing Jeff Mullins.

Governor Justice appointed Delegate Lynne Carden Arvon to the vacant Senate Seat for State Senatorial District 9 representing Raleigh County. The seat was vacated when Senator Jeff Mullins resigned earlier this session.

Senator Arvon was sworn in by Senate President Mitch Carmicheal in the Senate Chamber surrounded by family and colleagues from both the House of Delegates and Senate.

 

House Moves Four Bills to Senate

The House convened today at 11 a.m. during the thirteenth day of the Legislative session.

The House passed four bills: House Bill 3089, House Bill 4002, House Bill 4013, and House Bill 4026.

H.B. 3089 – relating to the adoption of instructional resources for use in the public schools – was passed 72-24. The bill will now move to the Senate.

H.B. 4002 – providing that all delegates shall be elected from one hundred single districts following the United States Census in 2020 – passed 72-25, moving it to the Senate for consideration.

H.B. 4013 – clarifying venue in West Virginia state courts as it applies to nonresidents of the state – passed unanimously, moving the bill to the Senate.

H.B. 4026 – exempting cashiers from licensure under the Larry W. Border Pharmacy Practice Act – passed 94-2 and will now be sent to the Senate for further consideration.

H.B. 2028 – relating to the venue for suits and other actions against the state – was read a second time.

Senate Passes Seven Bills

The Senate convened today at 11 a.m. and passed seven bills to the House for further consideration.

Of those bills:

SB 62 would expand the qualifications of hiring a county attendance director to allow for applicants with professional administrative certificates and five years of experience.

SB 110 would require vendors a license to sell alcohol to report any life-threatening medical emergencies that happen on their property to emergency medical services and law enforcement.

SB 263 would eliminate the film tax credit.

The Senate also adopted SR 12 and SR 13, designating January 22, 2018 as Women’s and Girl’s Day and recognizing Berkeley leadership respectively.

Senate Bills 334-338 were introduce for the first time today.

Senate Passes the First Seven Bills of Session

The Senate convened today at 11 a.m.

There were seven bills on third reading today.

SB 73 modified crime of fleeing from scene of accident,

SB 154 authorized  Department of Administration to promulgate legislative rules,

SB 297 eliminated taxation on annuity considerations collected by life insurer,

SB 298 authorized county assessors make separate entries in landbooks when real property is partly used for exempt and partly for nonexempt purposes, and 

SB 299  related to mandatory insurance coverage for medical foods for amino acid-based formulas – all passed unanimously.

SB 301 removed the limitation on amount collected by county via hotel occupancy tax used for medical or emergency services passed 26-5.

Other bills were read for the first and second time today.

SB 300 was amended on the floor to remove the limit on the amount an entity can take out for tax. The bill is to encourage development on post coal minning sites.

SB 322-333 were introduced to the Senate.

THe Senate adoted SR 11 which designated January 19, 2018, as Southern West Virginia Day at Capitol.

The Senate is adjourned until Monday at 11 a.m.

HB 4020 passes, Bills Advance to Third Reading

The House convened today at 11 a.m. for the tenth day of session.

House Bill 4020 – making technical corrections in the code when referencing chapter 49 – passed unanimously and will now be sent to the Senate for further consideration.

H. B. 3089 – relating to the adoption of instructional resources for use in the public schools – was read a second time.

H. B. 4002 – providing that all delegates shall be elected from one hundred single districts following the United States Census in 2020 – was read a second time.

H. B. 4013 – clarifying venue in West Virginia state courts as it applies to nonresidents of the state – was read a second time.

Senate Moves Bills to Second Reading

The Senate convened today at 11 a.m.

Senate Bill 300 was laid over on its second reading for one day. SB 300 will create a five year tax-credit for buisnesses locating on post coal mine sites.

All other bills on second reading were moved to the third reading. There were six bills read for the first time today.

House Bill 2869 was passed to the Senate and has been sent to the Government Organization Cmmittee.

Senate Joint Resolution 9, Governor Justice’s Just Cut Taxes and Win bill was introduced to the Senate. Senate Bills 310-321 were introduced today as well.

The Senate adopted Senate Concurent Resolution 6, to support construction of Gold Star Families Memorial Monument. It has been sent to the House.

Also adopted today was Senate Resolution 10 which designated January 18, 2018 as Tucker County Day.
